Terms and conditions
Last updated on 18 September 2026
1. Identity and contact details
These terms and conditions apply to the services of:
Delmont Capital BV, with its registered office at Jasmijnlaan 13, 1600 Sint-Pieters-Leeuw, Belgium, registered with the Crossroads Bank for Enterprises under number BE 1038.525.649, hereinafter “Delmont”.
Contact:
- general: info@delmontcapital.be;
- legal: legal@delmontcapital.be.
2. Scope and acceptance
These terms and conditions apply to every visit to the website, every request, registration, purchase, participation in a course, company course, follow-up session or other service of Delmont, and to every use of digital course materials, AI prompts, software, accounts and the Delmont Investment Framework.
By confirming an order or registration, the customer declares that they were able to read, save and accept these terms and conditions before the contract was concluded. Deviating terms of the customer apply only if Delmont has expressly accepted them in writing in advance.
When the customer acts for professional purposes, they are considered a business. When they act mainly for purposes outside their trade, business, craft or profession, they are considered a consumer. Mandatory consumer rights always continue to apply.
3. Nature of the services
Delmont provides financial education and general information. The courses, materials, examples, analyses, AI output and software:
- do not constitute personal investment advice, asset management, investment brokerage, legal advice, tax advice or individual financial planning;
- do not contain any recommendation or invitation to buy, sell or use a particular financial instrument, product, share, fund, ETF, broker or other service;
- do not take into account the personal financial situation, objectives, knowledge, experience, capacity to bear losses or risk appetite of a participant;
- offer no guarantee of return, result, profit or protection against loss.
Each participant makes decisions independently and at their own responsibility. Delmont does not receive client money and does not carry out transactions on behalf of participants.
4. Information, offer and conclusion of the contract
Delmont describes its courses and services as accurately as possible. Obvious typing, pricing, technical or material errors are not binding on Delmont. Images, examples and programme descriptions are illustrative and may be adjusted as long as the core and the objective of the course are preserved.
A contract is concluded as soon as:
- the customer confirms the online registration or order;
- expressly accepts the applicable terms; and
- Delmont sends a confirmation by email.
Delmont may refuse a request, stating its reasons, when no places are available, payment is not received, the details provided are incorrect or incomplete, misuse is suspected or the request is incompatible with the nature or security of the service.
5. Prices, VAT, invoicing and payment
The price shown during the ordering process is the applicable price. For consumers, prices are stated including VAT, unless clearly indicated otherwise. For businesses, prices may be stated excluding VAT if this is indicated unambiguously.
The course currently costs €350 including VAT, lunch, materials and the online follow-up session. For business invoicing, the price is currently €289.26 excluding VAT.
Payment is made entirely online using the payment methods available at checkout. The payment provider will be included in the privacy and cookie policy before the payment system is put into use. Delmont aims to offer common payment options, but does not guarantee that every payment method will remain available at all times.
Unless stated otherwise, the full price must be received no later than ten calendar days before the start date. For a registration less than ten calendar days before the start date, the price is due immediately. A place is only final once payment has been received, unless Delmont confirms otherwise in writing.
In the event of late payment by a business, the statutory interest and collection costs are due after formal notice, to the extent permitted by law. For consumers, Delmont applies only the interest, periods and damages permitted by law.
6. Statutory right of withdrawal for consumers
A consumer who registers online in principle has a statutory withdrawal period of fourteen calendar days from the day on which the contract is concluded. Within that period, the consumer may withdraw without giving reasons by means of an unambiguous statement to legal@delmontcapital.be or by using the statutory model withdrawal form.
When the consumer expressly requests that the service begins during the withdrawal period, Delmont may, in the event of withdrawal, charge a proportionate amount for the part that has already been performed, to the extent permitted by law. The right of withdrawal only lapses once the service has been fully performed and the consumer has given prior express consent to full performance during the withdrawal period and has acknowledged that they will thereby lose their right of withdrawal.
Where relevant, the registration page must therefore contain a separate, unticked checkbox to the following effect:
I expressly request that Delmont begins providing the service before the end of the fourteen-day withdrawal period. I understand that I will lose my right of withdrawal once the service has been fully performed and that, if I withdraw earlier, a proportionate fee may be due.
The contractual cancellation arrangement in article 7 does not limit the statutory right of withdrawal.
7. Cancellation by the participant
After the statutory right of withdrawal has expired, the following contractual arrangement applies:
- cancellation up to and including ten calendar days before the start date: free of charge;
- cancellation less than ten calendar days before the start date: cancellation fee of €200;
- absence without timely cancellation: cancellation fee of €200.
If the full course fee has already been paid and a cancellation fee of €200 is due, Delmont will refund the remaining balance. The cancellation fee can never exceed the course fee actually paid. Services that have actually been provided and can be valued separately may, to the extent permitted by law, also be offset.
A cancellation is only valid when it has been sent by email and received by Delmont. The participant is responsible for proof of sending.
Illness or another personal impediment does not automatically give a right to free cancellation. In a demonstrable, exceptional and serious situation, the participant may ask Delmont by email for an individual arrangement. Delmont may request strictly necessary supporting documents for this and decides voluntarily and on a case-by-case basis. An accommodation does not constitute an admission of liability, does not set a precedent and does not give others the right to the same arrangement. Mandatory statutory rights remain unaffected.
8. Substitution of a participant
A participant may be replaced by another person without a cancellation fee, provided Delmont is informed by email no later than three calendar days before the start date. The substitute must accept the applicable terms and provide all necessary details in good time. Delmont may refuse a substitution if it is practically impossible, conflicts with legal obligations or entails a security or misuse risk.
9. Minimum number, rescheduling and cancellation by Delmont
An open course in principle goes ahead from eight participants and has a maximum of twenty participants. If the minimum number is not reached, Delmont may cancel or reschedule the course. The participant then chooses between:
- free transfer to the next available date; or
- a full refund of the course fee paid to Delmont.
Within the limits of the law, Delmont is not obliged to reimburse indirect costs such as travel, parking, accommodation, lost working time or opportunity costs. Delmont informs participants as soon as reasonably possible.
10. Changes to programme, location and trainer
Delmont may make reasonable changes to the programme, order, timing, location, trainer, format or tools used when this is necessary or useful for quality, safety or organisation. Such changes do not give a right to a refund as long as the essential nature and objective of the course are preserved. In the event of a material change that reasonably prevents the participant from taking part, Delmont will look for an appropriate solution in accordance with applicable law.
11. Conduct, safety and exclusion
Participants treat other participants, staff, venues and materials with respect. Intimidation, discrimination, threats, disruption, fraud, unauthorised recordings, misuse of systems or behaviour that harms safety or the learning process is prohibited.
Delmont may exclude a participant after a warning if the behaviour continues. In serious cases, immediate exclusion may follow. To the extent permitted by law, exclusion because of attributable serious misconduct gives no right to a refund. The participant remains liable for any damage they cause.
12. Intellectual property and use of materials
All rights to the website, courses, presentations, methods, texts, images, models, checklists, AI prompts, software, reports and the Delmont Investment Framework belong to Delmont or its licensors.
The participant receives only a personal, limited, non-exclusive, non-transferable and revocable licence for their own non-commercial learning purposes. Without prior written permission, it is prohibited, in whole or in part, to:
- copy, publish, sell, rent out, sublicense or distribute material;
- share it with third parties or make it accessible to them;
- record, film, photograph or systematically reproduce it;
- use it to develop a competing course, method, database, software or service;
- subject it to scraping, automated extraction, reverse engineering or model training;
- remove copyright, trademark or ownership notices.
Permitted statutory exceptions continue to apply. An infringement may lead to immediate termination of access and to a claim for the damage actually suffered and all other legal remedies.
13. Delmont Investment Framework and free analyses
During the course, Delmont may offer a limited number of free tests of the Delmont Investment Framework. In addition, any user, even without taking part in the course, may carry out a maximum of three free share analyses after creating an online account, unless Delmont expressly states a different number.
This access:
- is personal and may not be shared;
- may not be circumvented by creating multiple accounts;
- depends on technical availability and may be changed, suspended or terminated;
- is a trial or introductory opportunity and not an acquired right to permanent free service;
- provides only general, automated information and no personal investment advice;
- may be incomplete, delayed or incorrect and must be checked independently by the user.
Delmont may restrict access in the event of misuse, security risks, incorrect use, manipulation, scraping or a breach of these terms.
14. AI output, data and external sources
AI systems and automated analyses can make mistakes, misinterpret information or use outdated data. Output may never be used as the sole basis for a financial decision without human review. The user checks important information against reliable primary sources and, where necessary, consults a recognised professional.
Delmont does not guarantee that external market data, prices, company information, news or sources are complete, up to date or free of errors. Delays and differences between data providers are possible.
15. Liability
The participant remains fully responsible for their own decisions, accounts, passwords, transactions, tax obligations and the use of the information provided.
To the extent permitted by law, Delmont is only liable for direct and foreseeable damage that is the immediate consequence of a proven contractual breach. Delmont is not liable for indirect damage, consequential damage, loss of profit or opportunities, price losses, missed savings, loss of data or damage caused by decisions based on course materials, AI output or analyses.
To the extent permitted by law, Delmont's total liability per claim is limited to the amount the customer paid for the service concerned. These limitations do not apply where liability cannot be excluded or limited by law, including, where applicable, in the case of intent, harm to life or physical integrity and other situations protected by mandatory law.
16. Force majeure
Delmont is not liable for delay or non-performance caused by circumstances beyond its reasonable control, including illness or unavailability of a trainer, fire, flooding, epidemic, government measures, strikes, transport disruption, power or internet outages, cyber incidents, or a failure at a venue, payment provider, hosting provider or other essential service provider.
In that case, Delmont may suspend the service, organise it digitally, reschedule it or cancel it. If final performance becomes impossible, amounts already paid for the part not performed will be refunded, unless another legally permitted solution is agreed.
17. Accounts and security
The user provides correct information, keeps login details secret and reports suspected misuse immediately. The user is responsible for activity via their account insofar as it is attributable to them. Delmont may impose reasonable security measures, identity checks and usage limits.
18. Personal data
Delmont processes personal data in accordance with the privacy policy and applicable data protection law. Medical supporting documents are only requested when strictly necessary to assess a request for an exception, are kept with restricted access and are not stored longer than necessary.
19. Complaints
Complaints should be reported as soon as possible, and preferably within fourteen calendar days of the incident, via legal@delmontcapital.be, stating name, contact details, registration details and a clear description. Delmont aims to respond substantively within fourteen working days.
The consumer always retains the right to use competent out-of-court dispute resolution bodies or courts, to the extent provided by law.
20. Electronic communication and evidence
The customer accepts that confirmations, invoices, practical information and legal notices may be sent electronically. The customer keeps their contact details up to date. Electronic records, confirmations, logs and correspondence may serve as evidence, subject to proof to the contrary and within the limits of the law.
21. Severability, non-waiver and changes
If a provision is wholly or partly invalid or unenforceable, the other provisions remain in force. The invalid provision will, to the extent legally possible, be replaced by a valid provision that comes closest to the original purpose.
Not exercising a right immediately does not constitute a waiver of that right. Delmont may amend these terms for future contracts. For an existing registration, the version accepted at registration in principle continues to apply, unless a change is required by law or is expressly agreed.
22. Applicable law and competent court
Belgian law applies to the contract. For consumers, this choice of law applies without prejudice to the mandatory protection they enjoy under applicable law.
Disputes with businesses fall exclusively within the jurisdiction of the competent courts of the judicial district in which Delmont's registered office is located. For consumers, only the court that has jurisdiction under mandatory applicable law is competent.
